Rajan Sriram Posted September 12, 2014 Report Share Posted September 12, 2014 I have L2 EAD till June 2015. I applied for H1B through company A and got that approved for 3 years till 2017 . Company A is staffing company. I am not happy with the projects they are getting me. I want to know if I resign my company A and get H1B papers from them will I be cap exempt if company B wants to sponsor. I read that I shouldn't resign before Oct 2nd in which case I will lose my H1B. I haven't applied for change of status yet. Does L2 automatically gets changed to H1B? Link to comment
jairichi Posted September 12, 2014 Report Share Posted September 12, 2014 If your H1B petition was approved as COS and if you want to continue working for L2 employer after Oct 1st you need to file COS or exit and enter US with a valid L2 visa. You will be cap exempt for H1B as long as employer A does not revoke H1B petition before Oct 1st. Link to comment
