I-140 approved in 2008; revoked by employer in 2009. Next Steps.

Hi,

 

I received a confirmation from my employer that they revoked my I 140 in 2009. It was approved in 2008. The PD is current on my I 140; is there anything I can do from here in India.

 

I am in India for last 5 years; want to move to US. Please suggest.

Approach an Attorney today itself.

 

My guess is you can retain the PD of 2008. Start looking for a new employer who can process your H1B. If your old employer still has the job offer you can do a Consular processing and that way you can get your GC in India and then leave for the US. I think you'll need to take this to an Attorney to discuss this situation.

You need to go through H1B quota again and if employer process GC then you will have to start from scratch. You can retain PD.
