Luckily she found an employer who was willing to apply for her H1-B he applied she got through the lottery her H1-B was approved but only for one year till 2015 my question is she has never applied or gotten H1-B before so why : 1) her H1-B was approved only for one year and not three years? 2) when her employer applies for an extension how much time will she get? 3) will she need to go through H1-B lottery again? jairichi Posted August 12, 2014 Report Share Posted August 12, 2014 USCIS has the discretion to approve H1B petition for any appropriate time. Employer has to file for extension before I94 expiry and it is cap exempt till she stays on H1B status for 6 years. Link to comment
