Fred
Hi , I was in USA, a year back on H1B visa stamped by company A for a year. Also I have an approved extension petition filed by company A for another year. However it's not stamped. Now I am in India. If I wanna go back to USA to work for company B , what would be more easier to go to USA ? 1. Get the visa stamped by company A for the new petition ? 2. Just keep the old stamped visa and new petition unstamped , so that company B can start a petition transfer from India ? Also what if the company A puts a "void without prejudice" stamp on my visa stamp. Is my petition still valid ? Can I make to USA once again on it ? Thanks Link to comment
rahul412
Now I am in India. If I wanna go back to USA to work for company B , what would be more easier to go to USA ? Get B's 797 and a valid visa (either A or B) at the time of POE. Also what if the company A puts a "void without prejudice" stamp on my visa stamp. Is my petition still valid ? Can I make to USA once again on it ? Employer's cannot revoke your visa. They can revoke just the petition, but not VISA. Link to comment
jairichi
As long as your H1B visa is valid you can travel to US with a valid I797 from employer B. And, employer A has no right to cancel your visa. They can only revoke your H1B petition which is irrelevant. Link to comment
