I recently traveled to India and returned with family along with my new employers I-797 petition and all three of us were given I-94 valid till the new petition expiry date ie 4/3/2016. Now my question is, do my wife and kid require new H4 visa to continue to stay in the US after 9/5/2014 or is it implied to be valid till 4/3/2016? Thanks in advance.! Arjun Link to comment
jairichi Posted August 8, 2014 Report Share Posted August 8, 2014 Once inside US the I94 expiry date matters and not the visa as visa is only an entry document. So, no need for a new H4 visa stamping to stay in US. Link to comment

Arjun VISA is only required when they enter into US. Not when they are already in US. Link to comment
