I have submitted my documents for H1B transfer to another employer Y and will join his company and work for him after I get the receipt number.My new employer Y will file for my transfer on Monday with premium processing.If my old employer X writes to USCIS and revokes my H1B before I get the transfer done am I in risk or what needs to be done from my side. pontevecchio Posted August 8, 2014 Report Share Posted August 8, 2014 Your old employer has to revoke the H1 petition by law and the process takes a few weeks or more. This has no connection to your transfer. Usually a few days will not matter depending on employer credibility. Worst case the Petition is approved without an I94 in which case you will need to leave and return with the visa/. Link to comment
JoeF Posted August 8, 2014 Report Share Posted August 8, 2014 H1 revocation is completely irrelevant. You are out of status from the day of layoff, H1 revocation or not. The day of layoff matters, not the revocation. This has been explained here lots of times. Link to comment
