My case is that, i had H1-B in 2009 where i went through a Master's cap as i did my MS degree in USA. Then came back to India for Persona;l reasons without using the full H1-B. Worked in India then went to Bahrain for like 6 months before returning. Now one employer is showing some interest in filing my H1-b back. So i wanted to know if i will have issues while filing or during visa interview. Also i need to know if i need to apply as fresh H1-B or like an extension as i haven't used my H1. jairichi Posted August 5, 2014 Report Share Posted August 5, 2014 Since you have been cap counted once and have not used the max allowed stay of 6 years on H1B visa your new employer can file a cap exempt H1B petition. On petition approval you can go for H1B visa stamping and enter US with valid H1B visa and I797. Link to comment
