H1 B TRANSFER FROM INDIA

Hi,

 

I had valid H1 B from one company.  Since I wanted to resign from this company (refer as company 1)  I have transferred my H1 with another company (Refer as company 2)  H1 got approved and I got stamped in India.  I am presently in India only.  As this company 2 not able to show suitable openings, I have decided to stay back in India and find an employment and travel to US through new company. (Refer as company 3) whenever opportunity comes.

 

Question 1:  Can I go to US any time with my valid H1 B visa without any support from the company 2?

 

Question 2:  Can I opt for transfer of my H1 visa from India without any support from Company 2?

1. Yes, with a valid H1B visa and I797 from employer 3 you can travel.

2. You will need a copy of employer 2's I797.
