jaxtrprahsant Posted July 31, 2014 Report Share Posted July 31, 2014 Hi, I heard about the rule of H4 visa holder getting EAD Permit, if H1 has completed 6 years and also I140 is approved. In our case 6 year of H1 is complete and I 140 is also approved. Now we are in the process of transferring H1 , so we have to start Green card process again. If H4 EAD rule is implemented will we be eligible for H4 EAD permit even if our 140 is not approved. I know H4 EAD is long shot, but just wanted to clear our doubts. Link to comment

H1 transfer doesn't take more than 4 months, are you worried about those 4 months?? Link to comment
itsmeusa Posted September 11, 2014 Report Share Posted September 11, 2014 @VenkatRRRR - Yes, your spouse would be eligible for H4 EAD immediately if that becomes the rule as you satisfy the requirements - completed 6 years on H1b and have I-140 approved. Link to comment
