H4 EAD Rule

Hi,

 

I heard about the rule of H4 visa holder getting EAD Permit, if H1 has completed 6 years and also I140 is approved.

 

In our case 6 year of H1 is complete and I 140 is also approved. Now we are in the process of transferring H1 , so we have to start Green card process again.

 

If H4 EAD rule is implemented will we be eligible for H4 EAD permit even if our 140 is not approved.

 

I know H4 EAD is long shot, but just wanted to clear our doubts.

Forget about this rule!!! Its not going to happen anytime!! Get that into your head.

H1 transfer doesn't take more than 4 months, are you worried about those 4 months??

@VenkatRRRR - Yes, your spouse would be eligible for H4 EAD immediately if that becomes the rule as you satisfy the requirements - completed 6 years on H1b and have I-140 approved.
