Please advise that should I need to leave the country to recover the days if there is a delay in getting the approval of PERM. How long will take to process I-140 if it is premium. jairichi Posted July 31, 2014 Report Share Posted July 31, 2014 Yes, you need to leave the country before H1B expiry to have some days to recapture when applying for transfer. An 1-40 receipt notice will not be make you eligible for extension. Link to comment
