raajeshh
I'm currently with Employer A on L1B VISA. I have served in India for 2+ years in the role of manager with the same company and for the past 4 years I have also served in the roles of manager/sr manager. My Company is asking me to apply for GC under EB2 category. Since I requested for EB1 option, as i match "Multi National Manager" eligibility, they informed me that I apply now on EB2 and subsequently upgrade the application to EB1 category. Is this a possibility? I came to know that EB2 goes through Labor (PERM clearance) whereas EB1 doesnt go through these steps. After applying on EB2, Can I even think of upgrading? If so can you please let me know the process. Link to comment
omshiv
Your company is asking YOU to apply for EB2? Just because you got the title as a Multi National Manager would not mean you are eligible for EB1...that would be an abuse of EB1. Take your credentials with an Attorney like the Murthy Law firm. "I came to know that EB2 goes through Labor (PERM clearance) whereas EB1 doesnt go through these steps." This language does not look like coming from a Multi National Manager. Link to comment
rahul412
You need attorney's help to check your eligibility. Not all Manager positions are eligible for EB1. Link to comment
