Hi Experts,

I am currently on a H1B with a recognized American Employer and got 3 years when i did my H1 Transfer based on my previous company's I140 and my I94 in my new I797 is expiring in 2016.

My 6 years cap on H1 ending in Oct 2014, this year.

My previous company revoked my I140 after i switched that company and my new company recently applied for my Labor which is still in the first stage.

If i go for stamping at this scenario, will there be any issue? Will there be any questions on my job change ? and i dont have a valid I140 currently, will it became an issue during the stamping. Please clarify?

Thanks

"The green card process is unrelated to your H1B process and the ability to go for stamping. So it won’t be an issue."

This is the reply i got from HR of my company, so it wont be an issue right?

All i worry about now is, even though I have my current I94 till May 2016, my 6 years in H1B is ending on October 30, 2014.

and i will go for stamping in October 2014 only, Will it be a problem?

Thanks in advance.

Since you have an extension approval based on I-140 (active during extension approval but currently revoked) it will not be an issue for stamping.
