Srinivas777 Posted July 25, 2014 Report Share Posted July 25, 2014 Hello Sirs, I was working in company 'A' and company 'B' sponsored my Green Card from outside in year 2005. In August 2008 I received my Green card through sponsored company 'B' with whom I never worked earlier. I left company 'A' in July 2009 and tried to work with company 'B', as I thought at least for 6 months I should work with GC sponsoror. But the project for which my GC was filed was closed and hence company 'B' even could not take me into their PAYROLL. I was not paid any salary. They tried but could not get me any project. Hence company 'B' permitted me to search a job on my own and go any where. After a 3 months gap I could find a similar software developer job in company 'C' and still continuing there. Now I want to apply for Citizenship. I request some one to advise me whether I will have any problems? If citizenship is denied, can my Green card be revoked or I will not be able to renew? omshiv Posted July 25, 2014 Report Share Posted July 25, 2014 I dont think your Citizenship would get denied because of the reasons you mentioned. Probably you can get a letter from Company B saying that they didnt had a project for you...but that would be a fraud GC then. Wait for other senior member's say. Link to comment
JoeF Posted July 25, 2014 Report Share Posted July 25, 2014 This could be problematic, since company B continued with the process even though they did not have a job for you. That could be seen as immigration fraud. You should discuss your situation with a good immigration lawyer. Link to comment
pontevecchio Posted July 25, 2014 Report Share Posted July 25, 2014 You need to get a Lawyer to advise you. It is extremely unlikely that you will face any problems. Citizenship can only be denied if they allege fraud in which case it affects your GC too. As I said an extremely unlikely scenario. In the interests of abundant caution keep a Lawyer onboard. The company 'B' did sponsorship in good spirit. So, do you think, I got high risk if I go alone and file for Citizenship. I request somebody to provide me link for downloading citizenship form to study the fields to be filled before I approach lawyer Sheela Murthy. Even earlier, before joining company 'C' I took advice from Sheela Murthy whether I can join or not without working for company 'B'. Thanks. Link to comment
pontevecchio Posted July 26, 2014 Report Share Posted July 26, 2014 If it is the case that you were a former client of the Murthy firm then stop wasting your time in the forum and make an appointment with them to discuss any issues. GOOGLE will give you the form and instructions. Basically if you were sponsored for a GC and fully intended to join the sponsor and if they laid you off, you are not at fault. Link to comment

I was asked to wait up to 7th or 8th year to file my citizenship. Now me, my wife and my son got green card. Can my son file for his citizenship on his own as he is more than 21 years old? Can my wife file for her citizenship on her own before I file for me. Does she require to file through attorney? If she files on her own , is there any possibility of denying of her citizenship, as I could not work with my GC sponsor in the past? Pleas advise. Link to comment

"almost every other person in IT (it appears you too), never works for their sponsor..check with your fellow buddies.." to clarify...all of my friends who did so got their citizenship already.... you did not say why u were told to wait few more years.. In 2002, I was working on H1b and GC filed initially(Company A), for which my PD was never current. Then, a new employer (Company B) filed for my GC (Employment based) in 2012 and received my GC with in Six months. But, I never worked for my GC sponsoring company(Company B), because they went through some organizational changes right after I got my GC and decided not to hire me. Now, I have Citizenship scheduled on Dec 20th. I was hoping that you didn't experience any adverse effects on the day of your interview and became a US Citizen by now.
