Below are the dates Notice date June30,2008 Valid from 10/01/2008 to 03/27/2011 But I didn’t go for visa stamping subsequently I have changed the company. Recently I have requested previous company to file h1b they informed me that filling is not required for my case. I am under the CAP exemption category. I have the below queries. 1) Am I under cap exemption category? 2) If it is when should I go for VISA stamping? 3) What will be the expiry date for I-797B Thanks Advance SubbaRao Link to comment
jairichi Posted July 16, 2014 Report Share Posted July 16, 2014 1. Yes. 2. If you have a valid H1B petition. 3. Your I797 has already expired. An employer has to file a cap exempt H1B petition and get it approved. Link to comment
omshiv Posted July 16, 2014 Report Share Posted July 16, 2014 You need to find a new employer...it seems like he does not know anything...or maybe he does not remember the dates. Your employer would need to file a new H1B...and yes you are CAP Exempt. Link to comment
