I am told it takes 150 days to file for PERM (90- PWD & 60 -advert & cooling period). So, it could be Nov 19, 2014 before my PERM can be applied. However, My H1b expires in Oct 15 & I should apply for PERM 12 months before it expires. I have 88 days that I can recapture(time away from US). Company Attorney suggested me to leave US for a month so I can get extra cushion. is it really necessary to leave? I do not want to go on a vacation if I can avoid it. Please let me know. omshiv Posted July 10, 2014 Report Share Posted July 10, 2014 I guess you are worrying too much...if everything happens good and your PERM gets approved within 6 months, you can then apply I-140 in PP and get that approved in 15 days...you should not have any issues. Link to comment
