SheetalTiwari
I am currently working with Company A on L1 Visa. Company B filed H1B visa in FY15 quota. Petition approved but CoS rejected since I had leave US because of some personal issues. Can a company C file a new H1B petition now? Link to comment

But, check contract with company B as you might be liable for damages if you have signed anything stating so. Link to comment
SheetalTiwari
Thanks for the reply. Sure. I'll contact Company B on that. Is the petition going to be filed by Company C is Cap Exempted? In few blogs, it is mentioned that, it needs Paystubs for transfer. Since I never worked for Company B, I don't have any paystubs. How am I supposed to handle this? Link to comment
jairichi
Yes, company C can file a cap exempt H1B petition. If you are currently working on L1 you will need to provide those latest pay stubs to show that you are on valid status in US. If you are currently outside US no need for any pay stubs. SheetalTiwari
Thanks for your reply. Does the company C requires I797 and I129 documents which was filed by Company B? Is that enough to have file receipt no? Link to comment

SheetalTiwari
As I mentioned before, I am currently working with Company A on L1 Visa. Company B filed H1B visa in FY15 quota. Petition approved but COS rejected since I had leave US because of some personal issues. Query: My L1 is going to expire in July 2015, now can I apply L1B extension from Company A and H1b transfer to Company C at the same time? Will there be any problem for L1B extension or for H1B transfer? Please let me know. Link to comment
