Passport expiring prior to the petition end date

Hi All,

 

My petition is valid from July 7 2014 till July 7 2017. 

My passport is valid till 20 December 2016.

 

 

My question is will i get visa as per the I797 document or as per the passport expiry date?

I am a bit confused here.

As per I797 but your I94 might be stamped till passport expiry date.

as per I797 but i would recommend to renew passport first. Thats what i did last time.

you will get it as per Petition Date not according to PP expiry. So no Issues, when your pass port expires, you will carry both old and new PP, show then visa from old PP at POE.

 Renew is only possible if passport is about to expire in a year. Is there any other option that you know?

You are correct. No other option.

You would get your visa stamping till the end date on I-797 but your I-94 would be valid till your passport expiry and once you get your passport renewed you can make a trip out of the country and get a new I-94 valid till visa expiry.

 

AS per you dates: 

VISA -till July 7 2017. 

I-94 till 20 December 2016. 

After passport renewal and trip out of the county new I-94 would be till July 7 2017.
