liquidation damage- Need urgent help

I left the job as my employer was unable to pay me on H1b visa for long time.

I have not yet received my back wages from DOL.

My employer is suing me for $ 20000  for his loss which is not reasonable.

 

 

1. What kind of attorney will be able to handle my case? And where will I find one?

2. Should the attorney be from the same state as employer ( court from which summon is sent to me)?

3. What are the results of these cases usually?

 

My prime concern is the money and time I will be spending to resolve this matter while working full time.

 

Please guide me.

You need a labor lawyer and an immigration lawyer.

If the employer didn't pay you, it is pretty easy to argue that the employer broke the contract, so you wouldn't be liable for liquidated damages.

And it seems that you filed a complaint with DOL. Keep them in the loop as well. This looks like retaliation, which is prohibited.

=> File WH4 on your states DOL site. They will assign investigator and force your employer to pay you for unpaid pay cycles.
WH4 form is made to save H1b rights.
