Is it Legal to work remotely on L1 with no intent to come back to US on L1 status

Supporting scenario:


1. I am on L1 visa extension (I-797) no stamping on my passport for L1 Visa.


2. I am planning to travel to India for getting my F1 visa.


3. While I am in India I will be still on US payroll of my company and I will be working remotely


4. I am planning to resign from my company after getting the visa (serve a 2 week notice period) and then travel from India to US on F1 visa.


 


Question:


Is it legal for me to work remotely for my company from India , when I have no intention of coming back to US on L1 visa ?


Could it affect my F1 / any other visa in the future.

Yes, it is legal. No impact on your F1.

If you are outside the US, you by definition don't have a status.

You can work remotely, but you have to pay taxes in the country you are in. Both the company and you should discuss this with a good CPA knowledgeable about international issues.
