1. My wife was on H4 until Jan 5, 2014

2. Her H1B approved on Jan 5, 2014

3. Looking for job for 5 months and no success. Employer did not run payroll not even once.

 

Now she want to convert back to H4 again.

 

What are our options now?

How many days we are allowed to stay on H1B after approval without payroll?

What are the possible issues if we apply for H4 COS from H1B?

No payroll = Out of status.

She cannot be staying in US for a single day without a payroll after joining employer.

File a complaint against employer with DOL. This will help her to get her salary for those 5 months and also to move to a new employer or change to H4 status.

Her COS will be rejected bcos you need latest paystubs for approval.

You cannot stay on H1 without getting paid not even for one day(unless and until you got some serious problems), you are currently out of status.

 

The ONLY option you have is to file a complain against that FRAUD employer ASAP.

 

Just wondering how did that insane employer filed your H1 without a job??
