If she travels to USA on H4 during January of next year will I be eligible for H1b cap exempt ? Waiting for an early response. Regards Prem Link to comment

shandan Posted June 2, 2014 Report Share Posted June 2, 2014 I am hoping you had a typo in your original post, as her having a old H1 and now being on H4 will not give you any expemption from the H1B cap. Yes, if her future employer desires to file for her H1, that filing can be done cap exempt. Link to comment
