L1 max duration reset

Hi,

I had been working in US on L1-B from july 2010 till Sep 2013.

My visa expired on Nov 2013, from then till now I am working in India,

 

My organization is planning to apply a new L1-B for me, if approved I would be getting this L1-B in Aug-14.

 

I would be travelling to US in the Oct-14 (so effectively would have spend 1 year outside USA).

I have a doubt that even though I would be outside USA for 1 year but since this visa will get applied within that 1 year only so whether  my L1 counter will get reset or not.

 

please suggest.

Only if your new L1B petition is filed after Nov 2014 your clock is reset. Otherwise you have 5 years - time already spent in US on L1B.
