s34rch
Hi, My H1b expires in June 2015 and my company just started the PR process. I am expecting them to file PERM by OCt 2014. I have a few queries regarding that If my Labor isn't approved by June 2015, I guess I have to go out of the country till my Labor is approved or 365 days passes. What if my PERM is rejected and my company appeals. Can I file for an H1B extension? Thanks Link to comment

Thanks Only with a PERM or I-140 pending for more than 365 days or I-140 approved an employer can file for extension. Approved labor will not help to file for extension. If PERM is rejected an extension cannot be filed even though your employer appeals. Link to comment
