H1B Extension and Travel

Hello,

 

Information:

  • My H1B expires on Dec 10th, 2014.
  • My employer will file for an extension in June or July, 2014.

 

Questions:

  1. Will it be ok for me to plan an India trip in the first week of december?
  2. Will it be ok for me to plan an India trip in October?
  3. If my H1B extension is filed and under processing, my current H1B visa expires on Dec 10th, and I show up at the US airport on Dec 7th, what will happen in that scenario?
  4. What are the chances that I will get my H1B extension approved within 3-4 months of the filing?
  5. If I get my approval in Oct or Nov, I think that will be the best scenario, and I will be ok to travel in december.
  6. If I get a RFE then how much delay in processing I am looking at, considering my extension is filed in June/July.
  7. Are there any other problems that can happen in the H1B visa extension process or other things that I should look at.

1. Yes.

2. Yes.

3. Depends on immigration officer at POE. Though you have a valid H1B visa still there is a possibility of denied entry as your extension petition is not approved.

4. Should be good. If not upgrade to PP

5. Yes.

6. Everything depends on how quickly employer/attorney response to RFE and USCIS timeline.
