Reuse old H1

Hi,

 

I was in US in the following period in L1 Visa.

Nov 2007 - Jan 2008

Nov 2008 - Oct 2011 ( with 3 weeks vacation in 2010 and 2011)

 

Then my company applied for H1 and it got approved upto Oct 2012.   continued my stay in H1 upto first week of March 2012

 

Oct 2011 - March 2012 ( in H1).

 

I went back to India in first week of March 2012. I stayed in India until August 2013.

 

In August 2013 my company processed a fresh L1 which is valid upto Aug 2016. I came to US in September 2013. 

 

My questions are

 

1. Is it possible now to reactivate my old H1 ?

2. If it is possible, will it be for 6 years ? (As I stayed in India for more than 1 year)

3. Or I need to apply for new H1 in 2014 April to get the 6 years period ?

1. Yes. You would get 6 years - time spent on L1 on the whole.

2.  To get full 6 years you need to get a cap subject H1B applied after staying outside US for a year.

3. Refer 2. Even if an employer applies in April 2014 you would get 6 years - time spent on your freshly approved L1 that you used to enter US in Sep 2013.
