URGENT: H1B - H4 VISA ISSUE

Hi,

 

I am currently on H1B Visa and my Contract with my current company get's completed on 28 Feb 2014,.

 

My Husband is on H1B and he is expecting a new offer from another company B and by March 2nd week  his new company will be applying his H1B Transfer .

 

Question1: I will not be on H1B officially since 28 feb 2014 is my last working day , what is the time period required to change my status to H4 i.

 

Question 2;

 

Can I wait till my Husband new Company B fills h1B along with that can I apply H4 ( or ) can I apply H4 with his Current Company A and wait

 

Question 3:

 

Do I need to leave country immediately

1. You have to apply on or before your last day with employer on H1B. It takes 3 to 4 months to get COS approval.

2. No, you cannot wait. You need to file now.

3. If you do not file now then you need to leave as you will be considered out of status.

Thanks  for the prompt reply.

 

Now if  I apply H4 with my Husband current company A and if my husband moves to new company B and my H4 will be in process with Company A then in that case how to transfer my H4 to new company B  

There is no need to transfer H4 whenever your husband changes employer. H4 is based on H1B employee being on valid status in US. If you get an RFE the provide your husband's new employer's H1B receipt notice or approval notice.
