I filed a new H1 extension and also MTR for my first denial. For some reason If my 2nd H1 denied than what are all the option I have: 1. Can I apply for one more time extension? 2. How many times I can apply and How many days I can leave in this country? 3. Can I change my status to H1 to F1? If yes, do I need stamping? 4. Is there any other option? Thanks in advance. Mohan Reason for denial? I might be wrong but you need to leave the country as your H1B extension was denied. MTR does not give you any status in US. Filing a new H1B extension after I94 expiry will not give you any status too to remain in US. 1. Yes. Any number of times as it is more revenue for USCIS. But, will your employer file"n" times. 2. Refer 1. 3. Now, no way. 4. Move back to home country and come back once H1B extension is approved. Link to comment
JoeF Posted February 25, 2014 Report Share Posted February 25, 2014 You would have to leave the country. Frivolous applications don't protect you. And forget this "change to F1" stuff. For an F1, you have to have the intent to return to your home country, which is obviously not what you want to do. Also, universities have application deadlines. You can't just "change to F1." And if you sign up with a fraud institution, you can really kiss your career goodbye. Link to comment
