artak
What does the VO mean when he/she asks the question, Is this your 1st H1b. My H1b was once rejected when I went for stamping, then another employer filed h1b and after its validity is over, my employer filed extension for me. So, what should my answer to the above question? Your answer is NO as your previous H1B petition was approved but visa was rejected. Link to comment
Consultant007
Did you work on the H1b that was rejected at stamping ? If you havent worked on the H1 that was rejected then that means that you havent used that H1. If you are in India, then that will be counted as "un used" period of H1 which people claim at the end of H1. But if you have ran paystubs on that H1 then thats your first H1. Usually when people ask that type of questions they want to know if it is change of status or H1 extension beyond 6 years. All depends on your case. Please validate my response with your attorney. It's clear that's not your first H1. Just explain the same to VO. Link to comment
m_dk29
There was a question in DS160 about previous visa refusals. So when asked explain the same answer that was filled. Link to comment
