bharat168 Posted February 23, 2014 Report Share Posted February 23, 2014 Hi,I have a valid H1b stamped Visa valid till Sep-2015, but current employer does not have oppening for travel.Its now more than a year, i am trying to get oppertunity but no luck. I never traveled USA on my stamped Visa.Recentlly i got a called from one USA consulting firm and they were giving a jobs in USA with my suitable profile.They told me to quite current employer and asked to fly (same state for with i got the visa) to USA on old stamped visa.They saying once you will be in USA, the H1 transfer wil be more simpler and we will do it withinn 2 weeks.Now, am i eligible to do this?Questions:1. Is it lawfull to travel USA after quiting current employer and travel on same employer visa?2. What if, there is any problem/verification issue on "Port of entry".3. Is it OK, to do what new employer is saying.?Please help on this.Thanks, Link to comment

You may be prosecuted for perjury depending on your answers. 3. No. Stay away from people who will land you in Ankle Bracelets or worse. Link to comment

Do not go with employers who suggest you this strategy. An employer has to file a cap exempt H1B petition and on approval you can travel to US with a valid H1B visa and I797 approval notice. t75 Posted February 24, 2014 Report Share Posted February 24, 2014 NO. Do NOT have anything to do with an employer who suggests violating US laws. You may enter on the old visa ONLY if you have an approval notice for your new employer which is not the situation you described. Link to comment
