Can you please give me suggestions? Thx Based on approved I-140 you are eligible for H1B extensions and there is no need to go under cap. Link to comment
Attorney_15 Posted February 24, 2014 Report Share Posted February 24, 2014 If one has been outside of the United States long enough to be subject to the cap, current USCIS guidance allows one to choose whether or not to be subject to the cap. One would usually want to consult with an attorney for legal advice on whether it is worthwhile to subject oneself to the H1B cap or not. Link to comment
