H1B Extension -Perm Denied question

Hello all,

 

  Please clarify understanding the below situation( this is hypothetical situation,just trying to understand the consequences..)

 

Mr X 6 year H1b period ends on 02/20/2015. Perm was applied on 12/20/2013 but got audited on 08/01/2014 audit was responded on 08/20/2014. Two questions on this scenario:

 

1. while awaiting PERM Audit decision, can we extend h1b for one year,given the PERM was filled more than 365 days prior to H1b expiration..

 

2.Let's say,  Mr.X applied for H1b extension and got approved till 02/20/2016 but PERM got denied on 04/20/2015 does that revoke H1B extension status or can he continue to work till end of extended H1b period??

1. Only if PERM is pending for more than 365 days.

2. You can work till H1B extension date.
