Donut Posted February 20, 2014 Report Share Posted February 20, 2014 Hi, I am currently on H4 and 2 employers are wiling to file H1b for me. 1) Is it legal for 2 employers to file H1b at the same time? 2) If both the applications are approved, and I choose Employer A to work for, how do I cancel/revoke my h1 with Employer B 3) Will there be any issue with stamping? 4) If an issue occurs while stamping or COS, is my h4 maintained automatically or i have to reapply for it? Any comments/suggestions will be helpful. Link to comment

Any comments/suggestions will be helpful. 1. Yes. 2. Employer B will revoke your H1B as per law. 3. No. 4. If COS is declined then you will be on H4 status. Link to comment

Because of that, a genuine candidate might be loosing the chance of H1. Moreover, employer won't simply file for H1 if you have no intention of joining. Link to comment

It doesn't give you any better chances in the lottery. This is not like the Powerball lottery. Stick with one employer. Link to comment
