Due to personal reason I traveled back to India [on May 2013] and re-entered USA [On Feb 2014] via H4 visa. Obviously, When h4 was stamped they cancelled my H1B. Now a company is ready to provide me a job. Under such scenario, 1. How should I proceed with the Visa Process. 2. Can I be able to apply for COS from H4 TO H1B.[without CAP Exempt] 3. If yes, how long will it takes under Normal/Premium processing mode. 4. How much is the COS fee under Normal/Premium process. Could anyone please clarify. Thanks, Meera Link to comment

Ask employer to file a cap exempt H1B petition along with COS. On approval you can start working immediately. 2. Yes. 3. 3 to 4 months by regular processing and 15 calendar days by premium processing. 4. Employer will pay H1B fee and it is not your concern. $1225 in addition for PP. Link to comment
