satch69 Posted February 19, 2014 Report Share Posted February 19, 2014 Experts, Since my H1 is expiring and no extensions are available, my employer + lawyer had to file the i-140 without certain documents. Specifically, the last year tax returns were being audited by the accountant, so employer is unable to provide them until a few weeks after H1 expires. Once employer receives them, is it possible to add them to the pending i-140 (maybe using a receipt number) in an effort to preclude receiving an RFE / NOID? (we also just emailed the attorney for their opinion, just thought I'd check with the gurus here!) thanks, S Link to comment
Attorney_9 Posted February 28, 2014 Report Share Posted February 28, 2014 There's no harm in trying to send supplemental documentation to the USCIS, however without an RFE issued, they may not make it to the file and your employer could still receive an RFE asking for the same financial documents.
