Hi All,

I came US 1st time with my husband in Dec 2013 on H4 Visa  and applied for H1B in April 2014 and got H1B Approval. I started working from November 2014 to till Date. I have to go to my brother's marriage for 1  month in 2015 March so thinking for stamping in Canada.

I studied engeering in Mechanical from India and working in IT from past 9 yrs.

I have Client Letter where I am currently working, W2, Pay slips, I797, I-94, engeering degree, work experience papers, education evaluation as per US standards,

Can I go canada for H1B stamping ? Need your guidance on this.

Waiting for your experiences and thoughts

How will you justify to VO your degree being not related to IT profession?

You are not eligible to go to canada for a change in Status visa ie H4 -> H1, if you dont have masters from US.

Please refer to the website below, only change in Status allowed in canada is from F1 -> H1 with masters from US, or a direct H1 -> H1. No other change in status is allowed, is risky and not recommended

http://canada.usembassy.gov/visas/visas/categories-and-requirements/important-notice-for-applicants-seeking-a-first-time-student-f-m-j-or-worker-e3-h-l-visas.html

Almost every VO in canada is asking for masters details, and you might be inviting uncessary trouble or 221g and get stuck in canada for a long time. It is not recommended to go to canada. Even though there are few in this forum post that they got lucky, I dont think you want to take a chance on others luck.

So please go to home country for stamping, since you have all the documents it should be fine. Try to avoid, uncessary travel expenses and taking risks.

Thanks,

Areddy.
