Question:VISA stamping required if I change employer with valid visa?-Urgent Pls!

I heard from my company attorney, Visa stamping is not required as long as I’ve a valid visa on my passport irrespective of the employer, Is it true?

 

I have plan to go to India twice as I'm getting married on June this year, I need your advice desperately about the visa stamping.

 

Current Visa Details:

Visa/I-94 from my old employer A valid till Nov 2015

New H1 Petition Approval/New I-94 from the current employer B valid till Oct 2014

 

Travelling schedule to India: 

My Betrothal is on March 2014

My Marriage is on June 2014

 

My queries are below;

 

1. Is it safe to travel twice without having visa stamped on passport? However I will come back to US in much advance (June 2014) before the H1 petition expiration(Oct 2014)

2. Here is the scenario; Assume may marriage is done; 

 

My spouse has got stamped H4 visa based on my current employer B, when we come back together from India after Marriage(i.e June), Would there be any issues for me or my spouse at POE(?) since my spouse has got current employer(B) Visa in her passport though I have my old employer(A) visa in my passport.

 

Please help to advice the same, Highly appreciated your attention and comments.

1. No problem. You are fine. Carry your new employer's I797 along with your passport with valid H1B visa.

2. No issue as H4 visa is not employer specific.

Your Lawyer was and is right. Did you expect laymen and women in the forum to overrule him?

When you have valid stamping.you don't need stamping again,but u need to carry the new I-797,LCA with that, per of entry will ask, my friend did same in 2012.but check once with your employer also before Leaving usa
