Currently on a DWI PBJ, going to India for marriage, no stamping required, any issues ?

Hi,

 

I recently got a Probation Before Judgement for a DWI case , I am going to India in Dec 2014 to get married (girl is india). My H1B visa is valid till April 2015. But my wife will need to get H4 stamping done. So my questions are:

 

1) Is there a possibility that Visa officer might ask my wife about my arrest ? 

2) Since my visa is valid till 2015, can there still be a problem for me while boarding from India, or at port of entry ?

 

FYI . I do have court order that allows me to go out of country for marriage, so hopefully going out of country is not a problem.
