Joe03 Posted February 13, 2014 Report Share Posted February 13, 2014 My spouse got H1-B approved in Oct 2013.Due to personal reasons she went to India in Oct 2013 itself.She Converted to H4 recently in India.Is we need to update to Employer that she converted to H4 from india by having H4 stamping? After Updating her's H4 information to her Employer, If her's Employer will revoke/cancel H1-B Is she eligible to COS again from H4 to H1-B(till now she didn't use 6 years H1-B)? Please advise. Her H1B employer has to revoke her H1B petition by law once she stops working for them. However this will not affect the outcome of future cap exempt H1B petitions filed by prospective employers. pontevecchio Posted February 13, 2014 Report Share Posted February 13, 2014 Letting an employer know that you are not coming in to work anymore is common courtesy. Revocation is mandatory and will not affect her future prospects with a H1 sponsor. Link to comment

After entering into US on H4 her employer has to file for COS to H1 again. Link to comment
