Completed 6 years. Completed 1yr in India. Now what?

Hi everyone

 

I completed 6 years on H1B as of Jan 20 2013. I couldn't get my green card process started during this time and therefore I left USA on Jan 20th 2013. Since I have completed a full year outside USA, I know that I am eligible to apply for a new H1 visa this year. My question is, do I still have to file this new H1 visa only in April 2014? Am I allowed to file it any sooner? I hear rumours that persons who have completed 6 years on an old H1 visa and have completed 1 year outside USA do not need to apply in the regular pool that is open for everyone. Is this true?

 

Also, since H1 visas are only issued starting October 2014, does it make sense to start applying for jobs in USA right now? Is there any way I can begin working before my new H1 visa is issued? For eg: arriving on a project visa and later changing that to H1?Any other suggestions?

Absolutely what you heard is a rumor and do not believe them. You need to go through cap again and if approved you can start working only from 1st Oct.
