I recently got an offer from a profit company and they are willing to apply for the regular H1B for me. My question is that If I can still work for my current non-profit employer until the end of September, can the future employer apply for the regular H1B for me on April 1st assuming that they are willing to wait for me to start working on Oct. 1st? Will there be any issue such as dual H1B status? I am looking forward to any suggestions. Thank you very much! Link to comment

Yes, for profit employer can file a cap subject H1B petition this April and there are no issues. What you had mentioned is the way to go. Link to comment

Should I travel? Please advise. You can travel. Only when it is a COS it is advised not to travel as COS part of the petition would get abandoned on traveling before approval. Link to comment

If I am in a non-profit H1B now and later decide to move to a for-profit, during the period from April to October, can I still work for the non-profit? Can I wait till October to resign from my non-profit job? Also, in case my H1B is not picked, can I still continue in the non-profit? Link to comment
