Future Posted February 12, 2014 Report Share Posted February 12, 2014 Hi All, Can any one guide me on below case, I have worked in US from 2007/May -2009/Nov, i have come to india on Nove-2009, appeared for visa extension at US consulate and it has got revoked on Mar/2010, My employer filed amendment even that got rejected, Now i some other employer want to file a H1b for me, Question - Will i be come under New H1b Quota or Still i can be consider for Extension ?? shekar11# Posted February 12, 2014 Report Share Posted February 12, 2014 If you want 6 years of new H1-B then you have to go through quota. If you want to claim your unused period on your previous H1-B then yours is considered as extension or transfer to new employer. Link to comment

Your guidance here is appreciated If a cap exempt H1B petition is filed you would get the remaining of max allowed of 6 years on H1B. If a cap subject H1B petition is filed you will be eligible for 6 years. Link to comment
