Question Regarding H1B Stamping With EVVC Model

Hi All,

         I am planning for H1B visa stamping based on possibility (within a month are so). I have couple of questions please help with your inputs/experience.

 

1) Which place is better? I have 2 places in my mind Calgary & Jamaica, already applied for Canada visitor visa and waiting for approval.

 

2) I think for Jamaica we don't need an pre visitor visa approved. As I know we can get on arrival to Jamaica is this true? please confirm.

 

3) Last and important question I am working on EVVC model, I am trying to make as EVC but looks like it is not possible, if this is not possible can I go with EVVC model for stamping, could you please suggest. If yes, any additional documentation needed?, any additional questions to answer to VO's? please provide the list

I worked in EVVC model.. but since i had good rapport with client manager.. he signed my letter stating i am employed with A thus removing 2 V's from between!

what do you gonna do if vo asks the contract agreement between your employer and client?? Does your employer has that agreement?? Obviously he won't have that because you have TWO vendors in between.

just specify everything on client letter, and carry letters from vendors thats it, there is nothing wrong in keeping one layer extra and it is not crime or something, just carry all letters thats all

It's not a crime to have multiple vendors, but for an H1, you need to have an employer-employee relationship, with the employer controlling your work, and that is essentially impossible with middle vendors, because the client doesn't know anything about the middle vendors.

So, in practice, anything with middle vendors is essentially dead.

A denial is pretty much a guaranteed thing with middle vendors.

Avoid anything with middle vendors. That's a recipe for denial.

Ok. in My case  the top layer vendor company implements the project at client location  so they are technically client , so middle vendor mentioned in their letter as  ( client: top layer vendor company name - client name ).

 

and top layer vendor company dont provide any letters so too that email from them.

 

on client letter it is given as working through topvendor name and middle vendor name.

 

let me know what should be the explaination incase if VO raise the question, my interview is in next 3 days.

Hi All,

         Thanks for all your replies and suggestions, I am started planning for stamping around 2nd or 3rd week of April (I got to know the latest dates in Calgary is april 17 as of last week), I have another question Jamaica or Calgary? but some reason & better success rate I am thinking for Calgary, Actually as I mentioned  I am working in EVVC model and I got the client letter (which mentions clearly my employer name for all immigration rights and I am through xyz prime vendor and open ended project dates for another 3 years), same letters from both the vendors (2nd layer mentions all the names of the companies client, prime vendor, his name, my employer name with same client format). My employer started for amendment process as soon as he is done I can apply for stamping that’s what my plan.

 

Could someone please let me know is there any risk chances I am taking with EVVC model even though with all letters which clearly mentions, and suggestions on Jamaica or Calgory? please advice.
