L1B I94 to H1B..possibility of multiple H1

Sorry if this was already discussed, I searched the forum but could not get information on this.

 

My sitaution, I was on L1B expiring  Oct 2013 with I94 stamped till Feb 2016 (Employer A).

 

Applied H1B with another employer B with COS starting Oct 2014 valid till Sept 2016. Now I did not join my employer B yet, since my employer A had more lucrative position for me. Now employer A is going ahead to file my H1B. They don't know that I already have H1B.

 My questions are

 

- Can my employer A file a H1B for me considering that I already have H1B with another employer which I never joined.

- Since I never joined employer B, can I continue to work with employer A. What consequences do I have.

- How much time does one have to join the new employer? Should I resign immediately?

I believe your H1B start date was Oct 2013 and not 2014? If yes, then you working for L1B employer from Oct it is considered unauthorized or illegal work. Stop working immediately for L1B employer. And, you are out of status as you have not reported to H1B employer within 60 days from oct 1st 2013. You are in a very bad situation. Talk to an attorney asap.
