Travel on H4 while H1 is approved

Hello Folks,

 

I was on h4 until last week my H1 got approved. Unfortunately I need to travel to india for some unavoiable situation. So here my questions.

 

Can I still travel on H4 inspite of the fact that I have an approved h1?

Is the change of status from h4 to h1 automatic ie the moment h1 is approved, h4 gets changed to h1 immediately?

If I still travel on h4, am I jeopardizing my H1?

I travel on H4 and get my h4 stamped and do the change of status when I am back in the US. Is it possible?

 

Any guidance in this regard would be highly appreciated.

If your intention is to work then you need a H1B visa to enter US. If you enter with a H4 visa then employer has to file COS and pay H1B fees again. Only after approval you can start working for employer. No sane employer will be interested to take this route.
