KSubbu
Hello, My spouse came to US in Jun 2012 and her H4 visa got approved with her father name as the surname in the passport. My H1B expired in July 2013 and my extension is approved. Her Passport doesn't have a valid VISA now. My Wife delivered a baby in India and is in India now. When we enquired for applying passport for my kid,it was mentioned she should endorse my (spouse) name in the passport. If we did that,by default surname would change to my name I have the following questions 1.Her H4 petition is approved with her old passport, Do i need apply another H4 petition for her?2.Which passport details should i give in the DS160,while scheduling the interview?3.Once she enters US with new passport ,should we change her ITIN and State Ids?Please suggest Link to comment

Please suggest As far as I know it is not mandatory for her to have take your surname in her passport. Just leave it as it is. Link to comment
KSubbu
The passport officials mentioned it is necessary to have the passport updated with spouse name. Infact, they want my passport to be changed as well because the address in my passport and my wife's passport do not match! Link to comment

I believe you need to update only your spouse name in passport as you are currently married but it is not mandatory to change your spouse's surname/family name. Link to comment
