hscr2013 Posted February 10, 2014 Report Share Posted February 10, 2014 Hi, I am on a L1 visa right now with employer A. Employer B has agreed to do my L1 to H1 petition. This is for a H1 which I already have from 2008 but was never used. Employer B is in the process of filing petition for my COS from L1 to H1. My question is around the start date for me post approval of L1 to H1 COS:- 1. I need to give 2 weeks’ notice to employer A. Is it ok that once COS is approved, I can give that 2 weeks’ notice period after that? 2. If not, what is the best way to ensure that I exit from employer A by properly giving a 2 weeks’ notice. Thanks. Serve the notice period required by contract to your current employer and do that only after your COS to H1B gets approved. Link to comment
pontevecchio Posted February 10, 2014 Report Share Posted February 10, 2014 hAVE THE h1 SPONSOR FILE A h1 PETITION NON CAP FOR YOU AND GET IT APPROVED. tHEN GIVE YOUR 2 WEEKS NOTICE AND LEAVE AND COME BACK WITH THE h1 VISA. Forgive the caps. It is too much of a pain to retype. Link to comment

But someone had told me that as soon as COS gets approved, my status changes to H1B and I can't work on the L1. In that case, how can I continue working on that L1 to give the required notice? If your COS petition gets approved say 2 weeks before the end of Sept then serve 2 weeks notice period with L1 employer and join H1B employer on 1st Oct on H1B status. Link to comment
