If I ask Company B to sponsor my H1 then -Will it be just change of status or fresh H1-B? -Change of status from L1 to H1 , does it uses the H1 Quota or it is different process and can be done any time during the year? -If H1-B petition gets approved then , will L1 becomes immediately or Automatically deactivate/void or it remains valid till start of H1 i.e. 1st of October? -Do I have to go to India for stamping , If H1-B petition gets approved ? Thanks Shkul 1. Fresh cap subject H1B with COS or your could go for fresh cap subject H1B with consular processing where you need to exit and enter US with a H1B visa to be on H1B status. 2. Uses H1B quota. Same procedures followed. 3. If it is approved as COS then you have 60 days to report to H1B employer and you have to stop working for L1 employer from 1st Oct. 4. If H1B petition is approved as COS there is no need for visa stamping. Otherwise, a visa stamping is required. Link to comment
