prithwi1983 Posted February 10, 2014 Report Share Posted February 10, 2014 I work for employer A and and got an offer from employer B few months back and they have initiated H1B transfer(Premium Processing) and I got RFE (Client Letter) and they replied to RFE after 2 months and it is approved . In the mean time I got offer from employer C (Much better salary) and they have applied for H1B transfer with premium processing .I have again got RFE and the law firm has told they will take few days might be 1-2 weeks to respond to RFE. Now I have resigned from employer A and serving the notice period and planning to join employer B in 2 weeks . Now if I joined employer B in 2 weeks and then can I join back to employer C (Provided that transfer is approved) ? I will work for employer B for 1-2 weeks and in the mean time if H1B transfer of employer C is approved then I will join back there. My question is it legal or again I have to transfer my visa from employer B to employer C? Link to comment

Make sure that employer B cannot claim any damages for failing to honor contract, if anything specific is mentioned. Link to comment
