It's been more than 7 months now and the Processing times for TSC on USCIS website say 4 Months. Is anyone faced/facing a similar situation? Is there a way to call USCIS and gain more info? jn2011 Posted February 11, 2014 Report Share Posted February 11, 2014 Hi attorney_25 - My employer is saying lets wait for some more time not sure why he is saying so because it is already 5+ months now. Little worried ..but my 7th year h1 extn applied in regular processing on jan 5th got approved on jan 30th. Is it a good sign for I 140 to approve? Link to comment

Attorney_15 Posted March 3, 2014 Report Share Posted March 3, 2014 Upgrading a case to premium should not affect the case. Cases experience problems in regular and premium processing service. It is important to keep in mind though that if there is a 'security' issue that is the reason USCIS is delaying the I140 processing and the $1225 fee is sent with the I907 form, what is likely to happen is that USCIS would take the money and switch it and then not finish it in fifteen days. They do not give the money back in those situations. This is why the other Murthy Law Firm Attorney's advice is GENERALLY a good idea in these situations. THAT BEING SAID, this would be a case where it would be very important to consult directly with an attorney for specific legal advice because there might be a reason not to push the issue or throw premium processing money at the problem.
