But now i have another company B for full time position who is ready to file my transfer. I am currently in India right now and willing to travel anytime.I have the following queries, 1. Can company B file my H1B transfer without pay stubs as i havent travelled there yet? What is the risk involved and do i need to do a re-stamping? 2. I have great opportunities , but as I am at India , those job calls are getting missed. Can i come to US and then start to look for a right project? 3. Once i land at US, how long can i be without getting into the payroll. Meaning , I don't have a real offer right now and once i land there, i would not be able to work, as my company A does not have a project for me yet. Was thinking ,If I land there and find a job in a months time. Is it possible ? Any inputs on these , is highly appreciated. Thanks, Sai Link to comment

You can use your existing valid H1B visa and new employer's I797. 2. No. 3. Once you report to employer zero days. You option is not possible. Link to comment
JoeF Posted February 9, 2014 Report Share Posted February 9, 2014 First off, getting a project for you is the employer's task. You can NOT come to the US to "look for a project" without getting paid by the employer. "Looking for a project" is work, and you have to be on payroll for that. I suggest you find a better employer, one who follows the law. Stay away from shady, fraud employers like company A. Company B can file an H1 for you, and once it is approved, you can come to the US and start working for company B. And you of course need to get paid by company B then. Link to comment

You should have a job to enter into US on H1 3. Zero days. Again, you cannot enter into US on H1 to find jobs. Link to comment
